Transnet SENIOR LEGAL ADVISORS , Gauteng - Pretoria

Transnet Rail Engineering, an operating division of Transnet SOC Limited, requires the services of the following suitably qualified persons at its office in Kilner Park:

SENIOR LEGAL ADVISORS (2 POSTS) (Ref. HR/KLP/CS/E/703 & 704)

Reporting directly to the Head of Legal Services, the successful candidates will provide legal and administrative support to Transnet Rail Engineering and will be expected to progress through the functional competencies by demonstrating the legal skills and abilities needed to handle increasingly complex assignments.

Primary outputs: • Interpret relevant legislation and regulations • Provide legally sound opinions to line management • Draft, vet and negotiate contracts • Liaise with Corporate Governance on forensic investigation reports • Prepare submission documents for the restrictions of suppliers from doing business with Transnet Rail Engineering • Draft applicable line management documents, including delegation of authority letters • Handle compliance with applicable legislation and regulations • Apply general commercial legal skills in drafting, advising and negotiating commercial legal contracts • Research the applicable legal principles and apply them to the facts • Conduct and participate in litigation • Prepare legal documents, including briefs, pleadings, appeals, contracts and statements • Gather and analyse research data, such as statutes, decisions and legal articles, codes and documents • Provide detailed advice and ensure TRE’s compliance with all environmental and safety legislation • Conduct and participate in Board of Inquiries • Assist in drafting the annual legal and compliance plan for approval by the TRE Risk Committee • Comment on environmental and safety legislation, such as NEMA and Railway Safety Legislation • Provide proactive legal advice on various commercial legal issues, such as revenue contracts, PFMA and Competition Law.

Minimum requirements: • An LLB degree • 5-8 years’ experience in the Career Ladder/Career Path as an Attorney or Advocate (relevant post-admission experience) • Experience in commercial transactions • Experience in contract drafting and litigation • Experience in determining legal posture and interests and ensuring that business practices, policies and dealings of the organisation meet regulatory requirements to protect the organisation from legal action.

Knowledge: • Good knowledge and application of MS Word, Excel and Outlook, while knowledge and application of MS Projects would be added advantages • Excellent knowledge of the relevant legislation • Interpretation and preparation of legal documents and provision of counsel to corporate management on legal matters • Working knowledge of SAP would be an added advantage.
