Background

The Inland Water Resources Management Programme (INWRMP) forms part of a major donor-supported effort to strengthen and reinforce the mandate of IGAD on behalf of its member states. The key issues that the region has faced in the past decade are related to instability arising from poor governance and scarcity of water resources, coupled with the vagaries of the climate. Shortage of water undermines the people’s well-being and is at the source of conflicts.
There are a number of international rivers and lake basins, and transboundary groundwater bodies in the region. Six out of eight of the IGAD countries are riparian to the Nile. While several international agreements have been concluded over time to deal with water management issues within the Nile basin, there are not many agreements relating to the other shared water resources. The existing ones are dated and deal mainly with boundary demarcation and in few instances, with traditional water rights in border areas.
As for the national policy and legal instruments in force, there are imbalances among the IGAD countries. While Ethiopia, Kenya and Uganda have comprehensive and modern water laws, in Somalia provisions relevant to water resources are scattered in numerous legal instruments. The Water Resources Act of Sudan was promulgated in 1995, whereas South Sudan, being a new country, still has to develop its own legal framework. In Djibouti the Water Code is not implemented since the implementation decrees have not been adopted. The country’s scarce water resources are managed on the basis of a water master plan (Schéma directeur de l’eau) adopted in 2001. In Eritrea a draft water law has been in progress for about a decade.
The IGAD countries would greatly benefit from an overall regional policy and legal framework under which bi- and multilateral agreements for specific river basins (other than the Nile) and groundwater bodies would be developed. This framework would also be a driver for the harmonization of national laws, regulations and institutional arrangements, which would facilitate the implementation of the international agreements.
With this in mind, IGAD has started the implementation of the INWRMP, a result area of which is the improvement of policy and legal frameworks (Result area 2). The activities for this result area are: (i) the review of the existing policy and legal frameworks related to water resources management; (ii) the development of regional policy and regulatory frameworks related to water resources management; and (iii) the provision of support to the member states to adapt the policies.

Duties and Responsibilities

Under the overall supervision of the IGAD-INWRMP TA Team, the incumbent shall:

1.    Collect, review and analyze water resources and related policies, strategies and legislation, as well as the existing international agreements relating to the management of river basins and groundwater bodies in the IGAD region;
2.    collect, review and analyze information on water resources and related institutions (those involved in, or affected by, the implementation of water legislation);
3.    collect, review and analyze information on customary practices relating to or having an impact on water resources management;
4.    collect, review and analyze proposed national policies, strategies and action plans;
5.    collect, review and analyze existing studies and consultant reports, if any, on national policies, legislation and institutions;
6.    review and analyze water resources management issues in the country, and discuss these issues with officials of the national water-related institutions, with a view to identifying the issues of regional relevance;
7.    prepare a draft national report which shall highlight the gaps and strengths of the national policy and legal framework, as well as the issues arising in connection with water resources management in the country, indicating those which are of regional relevance and those which are national. The report shall follow the outline provided to the Consultant by the IGAD-INWRMP TA Team and shall contain recommendations for improvements in the policy-legal frameworks. If studies and reports prepared under other projects are available, reference should be made to those studies and reports;
8.    participate in a national workshop to present the draft report and discuss the findings and recommendations;
9.    finalize the national report by incorporating the comments and recommendations of the workshop participants.
The incumbent shall initially travel to Djibouti to discuss the national report outline with the IGAD-INWRMP TA Team, the national consultants from the other IGAD member countries and the regional consultant.

Competencies

The selected candidate should be fluent in English, and have:
•    Good knowledge of water resources management-related issues;
•    Knowledge of the legal and policy issues arising in connection with water resources management;
•    Knowledge of the main features, functions and powers of water-related institutions, whether at the national level or at decentralized levels of administration, or at the river basin level;
•    Writing and analytical skills;
•    Ability to work under pressure and deliver high quality results on time.
Qualifications and Experience
•    University degree in law, or in a water resources management-related discipline (but in the latter case the knowledge and understanding of policy and legal issues are required).
•    Minimum 5 years of experience working on water policy/legislation development.
•    Experience working with water-related institutions, international organizations, research institutes or NGOs dealing with water resources.
•    Computer literacy.
