NOTICE : Request for Expressions of Interest

The free movement of persons is one of the key pillars of regional integration that continues to lag behind among Africa’s regional economic communities (RECs). COMESA, EAC and SADC each have their respective legal frameworks dealing with the movement of persons. Under the Tripartite Free Trade Agreement, the three RECs have a unique opportunity to establish a common or harmonized regime for free movement of persons. However, the absence of reliable evidence on the interrelationship between migration and development results in limited understanding and interest in the opportunities presented by increased free movement. In order to fill this knowledge gap, and provide an analytical and empirical foundation to the Tripartite process, the African Development Bank wishes to undertake a “Study on the Free Movement of Persons in the COMESA, EAC and SADC Tripartite Area – Analysis of the Policy And Legal Arrangements”. 

The main objective of the study is to (i) promote greater understanding among Tripartite policy makers and negotiators on the potential benefits and any challenges presented by free movement; and (ii) present concrete proposals that can help to advance the legal framework governing free movement in the Tripartite region. This study forms part of a broader Bank project on migration in the Tripartite region.

The Bank now seeks expressions of interest from suitably qualified consulting firms to provide the following services:

1. Examine the national and regional legal framework within a sample of 13 Tripartite member countries and the 3 RECs (COMESA, EAC and SADC) dealing with cross-border movement of persons and migration.

2. Make recommendations on a possible harmonized free movement of persons and migration regime in the Tripartite and the steps towards achieving such a regime. 

The consultant will prepare a single report addressing each of the above deliverables. 

The African Development Bank invites eligible consultants to indicate their interest in providing the services described above which shall be for a duration of 6 months beginning not be later than January 2013. Interested consultants must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, etc). Consultants may constitute joint-ventures to enhance their chances of qualification. 

Eligibility criteria, establishment of the short-list and the selection procedure shall be in accordance with the African Development Bank Group’s “Rules and Procedures for the use of Consultants” (2008) which is available on the Bank’s website at http://www.afdb.org. The African Development Bank Group is under no obligation to shortlist any consultant who expresses interest.

Expressions of interest must be delivered through email in English or French by 15:00 hrs Local Tunis time on Tuesday 16th October 2012 under the heading “Study on the Free Movement of Persons in the COMESA, EAC and SADC Tripartite Area – Analysis of the Policy And Legal Arrangements”.
