Haiti Risk Management and Legal Advisor

PURPOSE OF POSITION:

Under the management of the Country Representative and in close collaboration with the Head of Risk Management and Audit Department, Legal Counsel and Haiti Support Team Coordinator, the Risk Management and Legal Advisor provides independent high quality risk management, legal and advisory services that are designed to add value and give management objective assurance on the effectiveness of the operation's management of risk, internal control and legal environments. The Risk Management and Legal Advisor also acts as an agent for change by making recommendations for continual improvement, therefore assisting management with the accomplishment of their assigned responsibilities.

KEY TASKS AND RESPONSIBILITIES

Risk Management Capacity Building, Coordination and Promotion

Promotes the IFRC's risk management framework to Secretariat, Haitian Red Cross and other PNSs staff as appropriate.

Provides operational staff with appropriate tools and guidance to manage risks effectively.

Promotes a culture of risk awareness and appropriate mitigation amongst management and staff by following up on action plans prepared by management in order to mitigate those identified critical risks. Facilitates risk management workshops as required.

Updates the Haiti Operation risk register on a regular basis.

Provides advice on and status of risk management related issues on a regular basis to the Country Representative.

Be an active participant to the Performance and Accountability working group.

Legal and Contract Risk Management

Provides support with the drafting/negotiation and be the focal point for all contracts, agreements, memorandums of understanding, and other legal documents for the IFRC. Advises on appropriate types of legal documents to be used and promotes the use of IFRC approved templates and coordinates with the Geneva Legal department for review of legal documents as required, including developing model agreements.

Validates all contracts prior to their signatures.

Be the focal point for communications with the local legal counsel, ensuring conformity with local laws, including Haitian Labor Law.

Coordinates with the Administration, Logistics and Human Resources departments for the safekeeping and tracking of legal documents and follow-up.

Coordinates with the Contract Manager for INA (Integrated Neighborhood Approach) projects and Logistics in the proper management of contracts.

Provides advice and support in relation to the Status Agreement, including enforcement of privileges, immunities and obligations of said agreement, and the integration of PNS.

Liaises with UN Agencies, ICRC, PNSs, governmental and nongovernmental organizations and collaborates with them on legal matters.

Fraud/Corruption Awareness and Prevention

Provides support and advice to the IFRC in relation to fraud prevention.

Promotes a culture of fraud awareness and prevention by identifying risks that could lead to potential fraud, promoting the implementation of fraud related internal controls and raising employee awareness of fraud risks (i.e. facilitation of fraud and corruption prevention workshops).

Provides support and advice to all National Societies operating in Haiti in relation to fraud prevention upon request.

Coordinates with the Risk Management & Audit department when fraud/corruption suspected cases are identified.

Internal and External Audit Coordination

Coordinates the activities of the internal and external auditors in-country and liaises with parties involved in the audit.

Be the focal point for and follow-up on the implementation of internal and external audit recommendations, including overseeing the audit management plan.

Provides support to the HRCS in relation to their audits and internal control reviews.

EDUCATION:

University degree or equivalent in Internal Audit, Risk Management and/or Law.

Basic Delegates Training Course (i.e. IMPACT) or equivalent knowledge (can be provided prior to mission).

Advanced degree in law and admitted to practice in a national jurisdiction (preferred)

Professional accounting, and/or fraud investigation designation (preferred)

EXPERIENCE:

Minimum of 5 years recent professional experience in Risk management or related field.

Previous significant experience in reviewing contracts in both French and English. (preferred)

Experience in working for humanitarian, charitable or not for profit organisation. (preferred)

Acquainted with International Federation policies, procedures and systems (preferred)

Experience in investigations and fraud and corruption related matters (preferred)

SKILLS:

Problem solver and creative

Good understanding of the principles and application of good corporate governance, business and operational risk management, and effective internal control.

Basic knowledge of law as applied to an International Organisation and/or Not-for-profit (preferred)

Good working knowledge of systems audit procedures and techniques. (preferred)

Knowledge of the principles, procedures, and techniques of financial and management accounting. (preferred)

Ability to communicate clearly and effectively, both orally and in writing with different audiences, adapting style to fit situation.

Ability to gather, analyze, and evaluate facts, and prepare and present concise oral and written reports.

Ability to establish and maintain effective working relationships throughout the organization.

LANGUAGES:

Fluent written and spoken English

Fluent written and spoken French

A good working knowledge of one of the additional languages of the Federation (Spanish, Arabic) would be preferred.
