Senior Manager, Project Contracts and Contract Administration Canada

The company has an extensive project development plan, which is expected to add six new mines between 2011 and 2017. In order to develop these properties, a dedicated team has been created to focus on Capital Projects. A key facet of this team is the Capital Projects Procurement group.
Position Overview
Barrick has created the role of Senior Manager, Project Contracts and Contract Administration to improve and enrich its Supply Chain capabilities for executing capital projects. The role is needed to enable Barrick to continue to develop a robust contracts capability and to standardize and improve its contracts formulation and administration capability that extends to multiple projects being developed simultaneously.
As an experienced contracts professional, the Senior Manager, Project Contracts and Contract Administration will be responsible for managing tenders and negotiating contracts for engineering services for the various phases of mine development projects (Scoping, Preliminary Feasibility, Feasibility, and Engineering/Procurement and Construction Management “EPCM”).
The Senior Manager, Project Contracts and Contract Administration will also be responsible for overseeing the Project Contract Administration Manager and the Capital Projects contracts administration function including the setting of standards and processes to improve the quality of field contracts issued by Barrick and its engineers (EPCM’s) during the execution phase of the various phases of mine development projects (Construction and Contract Close out). They will also oversee and assist, as required, in the resolution of contractor claims, as required by the Project Teams and the Capital Projects Construction group.
The Senior Manager, Project Contracts and Contract Administration will combine a strong mix of technical and contracts knowledge coupled with outstanding leadership, contract administration, project management and negotiation capabilities.
Key experiences will include: extensive experience with large-scale engineering and EPCM contracts involving a high degree of engineering development; a detailed knowledge of international EPCM service providers; experience in large capital asset contracts. The Senior Manager, Project Contracts and Contract Administration will interface with external engineering firms, major external contractors and service providers, internal and external finance, legal, tax and insurance advisors and internal project resources to develop strategies for managing tenders and negotiating contracts for engineering and/or EPCM services and large capital assets and to oversee development of processes and templates for managing active construction contracts and negotiating claims. They will also oversee the contract formulation stage and training in the development of comprehensive, clear statement of work (SOW) documents.
The role will have critical interfaces with a cross-functional resources from the Capital Project teams and including legal, finance, tax, insurance, engineering, construction and project controls personnel and shall ensure that contracting risks are adequately assessed and that risk assessment and mitigation planning is included as part of the overall contracting strategy.
The Senior Manager, Project Contracts and Contract Administration will have one or more direct reports at the Manager and/or Contracts Specialist level.
Extensive travel (up to 25 percent) to multiple overseas destinations is anticipated for this position.
Essential Duties and Responsibilities:
  • Work in close co-operation with Capital Project teams and EPCM’s to develop appropriate project contracting plans and execution strategies.

  • Work in close co-operation with Capital Project teams to develop appropriate engineering contracts (terms and conditions, scope of work, schedules, hourly rates, etc).

  • Work with projects teams to prepare issue, review and evaluate engineering and construction tenders for Capital Projects.

  • Work with engineering service providers, projects teams and other advisors (legal, finance, tax, insurance, construction, project controls) to negotiate contracts and the resolution of contract claims for Capital Projects
  • Oversee the management of ongoing engineering and EPCM contracts and the contract administration function, including administration of monthly status meetings, payments, claims and change orders etc. As required, assist in the management and negotiation of terms and conditions for long lead procurement items.
  • Oversee and assist in work with projects teams to develop and implement contact administration templates, forms and processes and to oversee training on their use
  • Develop and deliver training on the preparation of Statements of Work.

Qualifications for the role:
  • Bachelor degree (or equivalent)
  • Graduate degree such as MBA (preferable)
  • 15+ years of contracts experience
  • 10+ years of project contracts experience in a mining, oil and gas or heavy capital / engineering (EPCM) environment
  • Experience in working in a multinational / multicultural environment
  • Ability to travel to and work at elevation (+/- 5000 meters)
  • Spanish language skills would be an asset
