Background:

In line with the United Nations Development Assistance Framework in Iraq (UNDAF) and UNDP Iraq’s Country Programme (CPD), UNDP Iraq Rule of Law programme portfolio contributes to the UNDAF’s priority 1 of “Improved Governance, including the protection of human rights” and the 3rd outcome under this priority for Iraq to have “improved legal and operational Rule of Law framework for administration and access to justice.”

Rule of law and justice is the “centrepiece of governmental legitimacy.” Strengthening the rule of law is a priority requirement for Iraq, and is the key to creating conditions for the success and sustainability of security, national reconciliation, and reconstruction and development efforts. Together with the respect of human rights, it guarantees solid foundations for building up the capacities and infrastructures of the new State, in line with the Constitution and Iraq's international obligations.

The project “Criminal Justice Data Management in Iraq” is to further develop the capacity of justice institutions in Iraq to ‘integrate’ data, that is, to exchange data between justice institutions in a timely, secure, accurate and verifiable way.

The project builds upon UNDP Iraq’s work with the Higher Judicial Council (HJC) in developing a pilot Case Management System in four pilot courts in Iraq; this includes the capacity building programme for both administrators and system end user of Iraq justice institutions.

The stakeholder of this project is the inter-agency Working Groups (IAWG) that comprises of 14 institutions members, who are entitled to facilitate the implementation of the project.

The development objective of this activity is to contribute to formulation and development of Iraq Integrated Criminal Justice Information System to facilitate information sharing at key decision points in the criminal justice process. This process will takes place across the jurisdictions of Iraq criminal justice agencies and to enhance public safety, improve decision making, increase productivity and improve access to criminal justice information.

In this respect, UNDP will provide the technical assistance for the Government of Iraq to transfer knowledge and develop system enterprise architecture and business case including business process management, and standard data integration model. As well as designing of the pilot Software Application for Iraq integrated Criminal Justice Information System.

In particular, the technical support provided to this e-governance pillar will handle the followings aspect:

  • Gap Analysis of current and future vision and participate in the preparatory meeting for the project
  • Knowledge transfer, Lead, Design and Develop hand-in-hand with Iraqi Stakeholders the integrated system architecture and the business case

To date, there have been several programme that have assisted federal and local agencies with the administration of justice, including technology-related programs, as follows:

  • Higher Judicial Council (HJC):
  • Pilot Case Management System in four pilot courts in Iraq; this includes the capacity building programme for both administrators and system end users of Iraq justice institutions.
  • The arrest notice, investigation and courts decision information system - based on oracle database- this system is operated by IT department at HJC, where the data are collected and processed to the system on monthly basis
  • Ministry of Interior (MoI):
  • Detainees Information system –based on Access database- this system is operated by the IT department at MoI where the data are collected and processed to the system on monthly basis
  • Ministry of Justice (MoJ):
  • Prisoners and corrections information system – based on Access database – this is operated by the main Prisons administration at MoJ, where data are collected and processed to the system on weekly basis.
  • Ministry of Labour and Social Affairs (MoLSA):
  • Juvenile Correction information system – based on Access database – this is operated by the IT department at Juvenile department at MoLSA, where data are collected and processed to the system on weekly basis.
Iraq e-Governance brief background:

UNDP support for the e-Governance is part of its ongoing assistance to the Iraq, which aims at providing an integrated approach to e-governance for development within Iraq at the national, regional and local level.

The e-Governance Programme is considered a vital component for reforming and moderinising Iraq’s public sector. The GoI has formulated the national e-Governance Strategic Action Plan that aims to harnesses ICT tools to improve basic services to all and to promote all-round good governance, including increased public participation, better social equity and justice as well as a general enhancement of the transparency and effectiveness of public institutions in order to build the necessary platform for a competitive, robust and knowledge-based economy.

Several initiatives took place since the launch of the first version of the e-Governance Strategic Action Plan in 2010:

  • The first training of Master Trainers. Following this the national e-Governance training was launched in many training hubs across Iraq, to date, some thousands relevant government officials have now been trained in specific hubs across the country.
Beside this, many other important initiatives has taken place, such as:
  • The launch of e-Iraq Portal,
  • Developing of government inter-operability framework (GIF) and Enterprise Architecture framework
  • Development of 6 quick wins pilot e-service based on (SOA-BPM). This covers on-line services as medical visit reservations for the Primary Care Centres, obtaining birth certificates, registration of school attendance, subscription to water services and water fee collection and Social Welfare submission and tracking.
In particular, the e-Governance Action Plan set out the vision of a transformational model of effective and efficient government and service delivery for the Iraqi public sector. The e-Governance Action Plan concentrates on ten critical components for the transformational impact of Information, Communication and Technology (ICT) tools. For each of the ten core themes, key priority tasks were identified on a multi-stakeholder consultation basis. The ten critical components of the strategic action plan covering: Awareness Raising, Communication and Commitment; Human Capacity and Resources; Government Interoperability and Standards; Organizational and cultural change; Regulatory frameworks; Telecommunications infrastructure; Financial Resource Management, Monitoring, Evaluation and Assessments and Connecting Services and Citizens, and data and Information System.

However, the Iraq Integrated Criminal Justice Information System will be build within the context of the results achieved from developing the Iraq Government Inter-operability Framework and the National Enterprise Architecture. As well as within the context of the ongoing work for the Data Policy and standardisation components.

Duties and Responsibilities

Objectives:

Provision of senior expert(s) to assist UNDP-Iraq Country office in Knowledge Transfer and Developing of System Architecture, Business Case and designing the Pilot Software application for Iraq integrated Criminal Justice Information System under the Iraq Rule of Law”.

Expected outputs:

Taking into account the importance of this event, UNDP is seeking to engage a short term senior specialists with strong experience in integrated criminal justice information system.
The professional seniors specialist is required to work in close consultation with Government of Iraq counterparts and the UNDP governance team; the specialists will perform the following tasks:

Gap Analysis of current and future vision and participate in the preparatory of the project:
Support the Government of Iraq (GoI) in conducting the primary analysis of ICT current and future proposed vision of the Iraq Integrated Criminal Justice Information System within the targeted organisations at both national and local government level, and conduct a gap analysis to confirm the understanding of the current state of the targeted organisations from a people, organisation, process , technology, and data sets view, as well as the exchange of information view between targeted organisations.

To this respect survey questionnaires with the direction on how to conduct the survey need to be developed and submitted to the stakeholders to be collected by the stakeholders within ten days. Based on the provided questionnaire information, the draft gap analysis of current and future vision should draft and submit by the contractor.

The contractor is also requested to contribute to the preparatory meeting scheduled to take place in Amman from 3-5 September 2012. The subject matter senior expert(s) is requested to provide an overview of the integrated justice system, critical issues that need to address, and contribute in illustrating of best practices techniques, standards and general guidelines based on international experiences in successfully designing and developing ICT Integrated Justice System. During the meeting a discussion on the stakeholder vision and elaboration on the questionnaire and the information required to conduct the gap analysis should also be conducted.
In order to conduct the Gap Analysis, the bidder/the winner contractors is required to perform the following activity:
  • Design, prepare and submit the survey questionnaires with the direction on how to conduct the survey to assess the current state of the Iraq Integrated Criminal Justice Information System among the Justice agencies at both national and local government level
  • Conduct draft gap analysis of current and future vision
  • Participate the preparatory meeting
  • Knowledge transfer, Lead, Design and Develop hand-in-hand with Iraqi Stakeholders the integrated system architecture and the business case
  • To this respect, a workshop will be conducted with the targeted partners (expected 25 participants for 12 working days) in Amman to transfer the knowledge on the subject.
  • The workshop should provide an overview of the integrated justice system, critical issues that need to address, and contribute in illustrating of best practices techniques, standards and general guidelines based on international experiences in successfully designing and developing ICT Integrated Justice System.
  • The workshop should provide guidance and help participants build skills and learn methodologies for designing and developing the Iraq Integrated Criminal Justice Information System architecture, business case and Project plan based on a new methodologies and international best practices and standard.
  • Ultimately, the bidder should Lead, Design and develop hand-in-hand with Iraqi Stakeholders the system architecture and business case.

By the end of the workshop it’s expected to generate the following outputs:

  • Construct the business case and Project plan of the front-end and back-end of the Iraq Integrated Criminal Justice Information System. This should include as well the Identification of a project portfolio of information systems applications, project phases and implementation methodologies, management of change plan, procurement plan, risk and quality plan, and cost estimation for the overall project.
  • Develop and design the business process re-engineering of the front-end and back-end of the Iraq Integrated Criminal Justice Information System, this includes the Current “AS-IS” high level business processes map and “TO-BE” business model detailing the services’ process flow, roles and responsibilities, reporting structure, performance measures (KPIs) and integration
  • Develop and design the data inventory set including schema and metadata with responsibilities, standard-based data sharing model, and data integration model and scenario of the Iraq Integrated Criminal Justice Information System
  • Design Data handling procedures
  • Design the security model
  • Design the data migration and backlog files scenarios.
  • Develop the Standard Operating Procedures
  • Design the views scenarios, search and reports
  • Design the mentioned pilot system prototypes and test scenario
  • Develop and design the requested infrastructure and hardware equipments specifications (including the fingerprinted system and any other requested equipment/software) and develop the bidding documents
  • Develop a training plan
  • Develop the implementation strategy

Deliverables and outputs:

While UNDP will be responsible for the logistic costs of the participants. The Consultant Under the direct supervision of the requesting unit, is requested to produce for the following deliverables:
  • Gap Analysis of current and future vision and participate in the preparatory meeting: (total 10WD)
  • Design, prepare and submit the survey questionnaires with the direction on how to conduct the survey , submit the preparatory meeting agenda and presentation outlines (3 WD)
  • Conduct and submit draft gap analysis (3 WD)

Required Skills and Experience

Qualifications and Requirements:

Education:
  • Advanced university degree in Information or Business Administration or engineering or computer science, or other related field, or first university degree and equivalent combination of education, certification and experience in relevant area.
Work Experience:
  • Having 10 years of international experience in planning and implementing justice information systems
  • At least 10 years experience in IT project management and system architecture
  • Experience in drafting ToRs for software development projects and technical specifications
  • At least 8 years of experience in analyzing, re-engineering and implementing business processes with ICT technologies in justice system
  • At least 8 years of experience in developing data inventory set in justice system
  • Track record of management and organizational skills in system development activities
  • Experience in the policy development process associated with e-governance development in developing countries and countries in transformation would be an asset;
  • Experience in working and collaborating with governments;
  • Thorough understanding of justice information in developing countries.
Language:
  • Fluency in English, both written and spoken and communication skills.

  • A brief methodology on how the candidate will approach and conduct the work.
The expert is asked in his/her offer submission in the methodologies section to describe the following:
  • The approach that the consultants will apply in delivering the Gap Analysis
  • The approach the consultant will apply to conduct the workshop and lead the knowledge transfer and development of the enterprise architecture and business plan.
Financial proposal:

The financial proposal will specify a total lump sum amount and payment terms around specific and measurable (qualitative and quantitative) deliverables. Payments are based upon output, i.e. upon delivery of the services specified in the TOR. A breakdown of this lump sum amount is to be provided by the IC candidate.
