Background

The European Union (EU), the United Nations Development Programme (UNDP) in Turkmenistan and the Office of the United Nations High Commissioner for Human Rights (OHCHR) are currently implementing a joint project entitled “Strengthening the national capacity of Turkmenistan to promote and protect human rights”. This project started in September 2009 with duration of 46 months. 

The overall objective of the project is to engage the Government of Turkmenistan on its duty and capacity to comply with its international human rights obligations and to improve the knowledge and capacity of rights holders to claim their rights. 

The main implementing partner is the Turkmen National Institute for Democracy and Human Rights under the President of Turkmenistan. The project follows the establishment of an Interdepartmental Commission for monitoring the implementation of international human rights instruments (IC) on the basis of a Presidential Decree in 2007. The mandate of this Interdepartmental Commission (IC) is to coordinate the activities of relevant organizations, ministries and agencies to implement the international legal obligations of Turkmenistan in the area of human rights. In addition, this IC is mandated to prepare the national reports on progress towards the realization of international obligations in the field of human rights for submission to relevant human rights mechanisms; to monitor national legislation of Turkmenistan for compliance with international human rights norms and prepare proposals to amend the legislation of Turkmenistan to conform with international human rights standards and principles. 

The International Covenant on Economic, Social and Cultural Rights is one of the core international human rights treaties to which Turkmenistan is a party. In its Concluding Observations of 13th December 2011, the Committee on Economic, Social and Cultural Rights has encouraged the Government of Turkmenistan to consider signing and ratifying the Optional Protocol to the Covenant. Taking into account this particular recommendation, the specific activities aimed at acquainting the members of Interdepartmental Commission with the Optional Protocol to the Covenant is envisaged in the Annual Work Plan of the project for 2013. 

One of the activities foreseen within the Annual Work Plan entails the organization and facilitation of a one day workshop devoted to the Optional Protocol to the Covenant. 

The members of the Interdepartmental Commission as the main target group of the planned activity have a broad mandate and objectives one of which is: Encouragement of Turkmenistan to accede to international human rights treaties according to the established procedure.

It is expected that the planned one-day workshop will acquaint the members of IC with the provisions of the Optional Protocol as well as the principles and procedures under which the Committee on Economic, Social and Cultural Rights has the competence to receive and consider communications from the citizens’ of a State Party which signed and ratified the Optional Protocol.

Duties and Responsibilities

In accordance with the overall objective of the project and under the supervision of the Team Leader/Human Rights Specialist, Human Rights Expert will have the following duties:

• During the mission to Turkmenistan to facilitate the proposed one-day workshop and provide additional specialist advice and expertise in relation to the Optional Protocol to members of IC; 
• Preparation of handout materials aimed at enhancing the IC members’ knowledge on the Optional Protocol to the ICECSR including the reference/information material on the advantages of signing and ratifying the OP which recognizes the competence of the Committee to review individual communications. The materials will have to be submitted at least 1 week prior to the workshop, preferably in Russian;
• Upon completion of the mission to prepare a mission report containing recommendations for the next steps with regards to Country’s signing and ratification of the OP.

Outputs:

• In accordance with the duties listed above, the International Human Right Expert is expected to deliver following three major products:
• Handout materials aimed at enhancing the IC members’ knowledge on the Optional Protocol to the ICESCR including reference/information material on the advantages of signing and ratifying the Optional Protocol;
• A one-day workshop on the Optional Protocol to the ICESCR;
• Mission report and recommendations

Deliverables and timeframe 

• Preparation of handout materials for the workshop for the members of IC including reference/information material on the advantages of signing and ratifying the Optional Protocol to the ICECSR
Home based-3 days, May 2013;
• Delivery of a one-day workshop on the Optional Protocol to the Covenant Field work- 1 day, May 2013;
• Preparation of mission report and recommendations Home based-3 days, June 2013 

Payment Conditions: 

This is a lump sum contract that should include costs of consultancy required to produce the above deliverables. The final schedule will be agreed upon in the beginning of consultancy.

Payment will be released in one installment upon timely submission of respective deliverables and their acceptance by the Project Team Leader/Human Rights Specialist.

Required Skills and Experience

Education:
• Advanced university degree in a relevant field, such as law, political science, international relations or a related field with a particular focus on human rights

Experience:
• At least 7 years of relevant working experience – consultancy in the area of human rights; 
• Experience in capacity and institution building in the area of human rights, in particular in relation to the CESCR Committee, ICESCR and OP ICESCR;
• Knowledge and experience of work in the CIS or Central Asia an advantage;
• Language Requirements:
• Excellent written and spoken English. Fluent Russian advantage.

Evaluation Criteria

The consultant will be evaluated against a combination of technical and financial criteria. 

Maximum score is 100. 

Out of the maximum score, the score for technical criteria equals 70% - maximum 70 points, and for financial criteria 30% - maximum 30 points.

The technical evaluation (70%, or max 70 points) will take into account the following as per the scoring provided:
• Education: 5 pts 
• In depth knowledge of UN human rights system, treaties and mechanisms: 15 pts 
• Relevant working experience: 18 pts
• Relevant experience in capacity and institution building in the area of human rights, in particular in relation to the CESCR Committee, ICESCR and OP ICESCR: 22 pts
• Knowledge and experience of work in the CIS or Central Asia: 5 pts
• Fluency in Russian: 5 pts

Financial proposal – 30% of total evaluation - max 30 pts

Only the highest ranked candidates who would be found qualified for the job will be considered for the Financial Evaluation.

Additional requirements for individual contractor

Individual contractors, if the travel is required, shall undergo a full medical examination including x-ray, and obtain medical clearance from the UN-approved doctor prior to taking up their assignment. The medical examination is to be cleared by the UN physicians, and shall be paid by the consultant.
