Under a new 24-month EU contract aimed at building Serbia’s capacity to manage migration in accordance with international and EU standards, the International Organization for Migration (IOM) is seeking consultancy services of a qualified individual that can fulfill the duties and responsibilities as outlined in the terms of reference below.
The overarching aim of the project is to contribute to the establishment of a Migration Management Framework in the Republic of Serbia in line with the EU acquis and to strengthen the capacity of central and local institutions to achieve EU standards in Migration Management, Readmission and the Reintegration of Returnees. In order to achieve this goal, CRS will work closely with government institutions participating in the Coordination Body for Managing and Monitoring Migration (CBMMM) and International Organization for Migration.
General functions: Under the direct supervision of the Team Leader the selected consultant will work in close coordination with the Commissariat for Refugees, the Coordination Body for Managing and Monitoring Migration and key municipal trustees to assess the strengths and weaknesses of the current migration management framework and finalise the set of recommendations for the organizational changes needed to transition CRS to the Agency for Migration model.
Tasks
1. Based on an assessment of Serbian legislation relevant for migration issues produce gap analysis report comparing Serbian legislation to the relevant sections of EU acquis chapter 2 (Freedom of Movement for Workers), 19 (Social Policy and Employment), 23 (Judiciary and Fundamental Rights), 24 (Justice, Freedom and Security), and 26 (Education and Culture);
2. Advise legislative changes to current Serbian legislation with a view towards EU acquis alignment;
3. Support CRS in drafting bylaws and other legal documents required to oblige national institutions to share migration relevant data.
4. Perform such other duties as may be assigned by the IOM Belgrade Chief of Mission and CBMM Programme Manager.


Desirable Qualifications and Experience:
• University degree in law, preferably with a international law focus; or an equivalent combination of training and experience. Five years of working experience in related areas;
• Excellent knowledge of the EU acquis and in particular its migration components;
• Knowledge of the EU migration system as well as migration trends and dynamics;
• Experience in supporting the drafting of laws and bylaws and drafting protocols for the inter-institutional sharing of confidential data and information;
• Familiarity with the legal system in the region and Serbia.

Competencies
• Demonstrated strategic thinking and ability to offer expert legal advice, formulate laws and bylaws;
• Ability to review and analyze legal documents;
• Expertise in migration management;
• Ability to work with governmental institutions;
• Highly developed English writing, drafting and oral presentation skills;
• Strong organizational skills, result oriented.

Languages
Thorough knowledge of English and Serbian.
