Moldova Administration and Management Consultant - Public Custody Centres


International Organization for Migration (IOM), mission to the Republic of Moldova is seeking consultancy services on administration and management of the public custody centres for irregular migrants.
Purpose: IOM is seeking a qualified Expert on Administration and Management of Public Custody (Detention) Centres for Irregular Migrants (MAC) to provide assessment and 2 days training for the MAC staff on Administration and Management of the Centre according to the existing Best Practices in the domain and Migrant’s rights and requirements.
TERMS OF REFERENCE
I. IOM Project to which the Consultancy is contributing: “Support to The Implementation of EU Readmission Agreements with the Republic of Moldova, the Russian Federation and Ukraine: Facilitation of Assisted Voluntary Return and Reintegration (SIREADA)”, 2011- 2013.
II. Title: Expert on administration and management of the public custody centres for irregular migrants (Migrant Accommodation Centre).
III. Contracting agency: International Organization for Migration, Mission to Moldova (IOM).
IV. Background information:
Within the framework of the project “Support to The Implementation of EU Readmission Agreements with the Republic of Moldova, the Russian Federation and Ukraine: Facilitation of Assisted Voluntary Return and Reintegration (SIREADA)”, with the Bureau of Migration and Asylum (BMA) of the Ministry of Internal Affairs (MIA) as the main beneficiary, IOM supports the Moldovan Govt. efforts in restructuring its migration management system that includes the operational framework related to the public custody of irregular migrants. The project supports as well the approximation of the Moldovan legislation and practices in the respective area with the relevant European and international best practices and standards. An important aspect of these efforts is related to the administration of the facilities used by the MIA for placing the irregular migrants under temporary public custody, namely: Centre for Temporary Placement of Irregular Migrants of the BMA of the MIA / Migrant Accommodation Centre (MAC) according to European standards and existing best practice in the area which pay due consideration to the appropriate protection of human rights of migrants.
As a specialized Unit within the BMA of the MIA, the Migrant Accommodation Centre (MAC) requires effective steering and management of a potentially overwhelming migrant placement activity and other services like humanitarian assistance, legal assistance, medical care, etc. An appropriate workflow management system is necessary to be put in place with appropriate division of labor and responsibilities. In view of the high staff turn-over at the MAC, including the administration level, periodic trainings of the staff on methods and peculiarities of the contemporary administration and management of the MAC in accordance to the existing standards and best practices is of paramount importance.
V. The overall objective of consultancy
The overall objective of this contract is to contribute to the improvement of the migration management capacity of the Ministry of Internal Affairs’ officials with a particular focus on the treatment and protection of human rights of irregular migrants under public custody and to support the Government’s efforts to comply with and ensure international best practices and humanitarian standards set by the Council of Europe, the European Court of Human Rights and the Committee for the Prevention of Torture and Inhuman or Degrading Treatment (CPT) as well as harmonization with the EU acquis communitaire. The Expert will work in close collaboration with the IOM Project team and other relevant staff assigned by state agencies involved.
VI. Specific Tasks to be performed by the Consultant
Under the present Terms of Reference, an Expert on Administration and Management of Public Custody (Detention) Centers for Irregular Migrants – MAC – (the Expert), under supervision and in cooperation with IOM mission to Moldova shall perform the following tasks:
  1. Provide assessment of the MAC Chisinau.
1.1. The Expert’s activity will encompass effective identification, differentiation and valuing of the management system within the MAC and mapping future training objectives for MAC managers/employees. The following subjects should be given special attention:
a) setting priorities and communicating them;
b) building optimized schedules and budgets;
c) clarifying duties and motivating team members;
d) accurately tracking work performance, identifying and solving problems;
e) monitoring and evaluating the standards of the work and services;
f) maximizing effectiveness of allocated cash and in-kind resources;
g) improving inter-departmental and inter-personal relations;
h) project Management and fundraising approach;
i) outlining specific recommendations for further improvement of the MAC administration and management.
  1. Provide 2 days training for the MAC staff on Administration and Management of the Centre
TIMEFRAME: In the second half of December 2012
  1. Provide 2 days training for the MAC staff on Administration and Management of the Centre according to the existing Best Practices in the domain and Migrants’ rights and requirements.
2.1 The Expert will build the 2 days training on Management and administration of MAC and will carry out the entire activity in accordance to his/her own experience in the area and based on the existing European standards set up by the Council of Europe, the European Court of Human Rights and the Committee for the Prevention of Torture and Inhuman or Degrading Treatment (CPT) as well as the EU acquis communitaire and relevant provisions of the legislation and legal norms of the Republic of Moldova on the matter. A due attention shall be paid to the best practices of management of public custody centers in European countries.
TIMEFRAME: In the second half of December 2012
2.2 Emphasis will be placed by the Expert on collaboration between the Bureau of Migration and Asylum which is the main agency dealing with the immigration and readmission issues in Moldova, Border Police Department and other relevant agencies. Moreover, in order to be consistent with IOM principles, the training should appropriately focus on mainstreaming gender issue and take into account the particular situation faced by most vulnerable migrants such as women, elderly, disabled persons and unaccompanied minors.

TIMEFRAME: Within 7 days after training completion, in the Expert’s country of residence.
VII. Expected Deliverables. Following performance of the tasks listed in section VI of this Terms of Reference, the Expert shall submit to IOM for approval and acceptance the following deliverables:
Deliverable 1
One visit to Moldova during which the Expert would spend up to 4.3 working days (in total) for MAC assessment and consultations with the beneficiaries and local partners according to section VI of this Terms of Reference.
Deliverable 2
Identification, differentiation and valuing of the management system within the MAC and mapping future training objectives for MAC managers/employees.
Deliverable 3
Prepare and conduct 2 days training on efficient management of the MAC, according to section VI of this Terms of Reference.
Deliverable 4
Report on the results of his/her services, which will include written recommendations on further improvement of MAC Administration and Management according to the mentioned above main requirements. It is assumed that the preparation and drafting of the activity report will be carried out in the Expert’s country of residence.
VIII. Period of performance: The Consultant shall perform all the tasks under this Terms of Reference during second half of December 2012 (dates flexible upon identification of the trainer).
IOM Moldova will arrange and pay the travel as well as the expert’s DSA for maximum 4.3 days visit to Moldova according to IOM rates established for the respective months. The Expert will also receive a fee for maximum 8 working days (EUR 350/day).
IX. Qualification requirements for the Consultant
a. Studies:
Masters degree in legal, social sciences, migration, psychology or other relevant field;
b. Work experience:
a) minimum 5 years of relevant professional experience in the domain of Migrants’ rights and Migration Accommodation Centers issues; b) significant experience of training design, training delivery and curriculum development; c) practical experience in evaluation and analysis, reports writing, and formulation of recommendations;
c. Skills:
a) strong facilitation and consensus-building skills; b) commitment to cultural diversity and migrants issues; c) strong administrative and logistical capacity to support implementation of the course; d) analytical skills, abilities in communication and group work; e) ability to meet deadlines and dates and to prioritize multiple tasks.
d. Knowledge of the following issues:
a) internationally recognized migrants rights protection standards and practices; b) administration and management of the Centers for irregular migrants; c) negotiation & mediation between state authorities, civil society and international stakeholders regarding migration issues; d) assessment of the needs of apprehended irregular migrants; e) best models of collaboration between Government authorities and civil society in administration and management of the public custody centers for irregular migrants;
X. Diversity:

b. Working knowledge of one or more additional languages relevant for Moldova, including Romanian, Russian, Bulgarian, Gagauzian, Romani, Ukrainian or sign language is an asset.
