Legal Counsel France Apple | France


Reporting into the legal head for South EMEIA (France, Spain, Italy, Portugal, Mediterranean, etc) who is based in France, the Legal Counsel role is a commercial position, which primary purpose is to provide legal support to the French business team, under French and EU laws, in relation to commercial law, commercial contracts, distribution, competition and consumer laws. The candidate will also be required to team up with other EMEIA Legal Counsels to advise on complex projects and/or to provide support to other Senior Legal Counsels within the EMEIA Legal Team, for example in relation to Apple Online Store activities.
Key Qualifications
  • The candidate will be required to have a French law degree in business law as well as a postgraduate legal qualification (e.g., DJCE, LLM).
  • 4-5 years experience in a commercial law firm and/or in-house, in both cases in an international environment.
  • The candidate must be bilingual in French and English (mandatory for the role). A good knowledge of one or more additional languages will be considered a plus.
Description
An in-depth knowledge of French law of contracts and French commercial law concepts and related case law is required for this role (i.e., termination of commercial relationships, “commercial cooperation”, negotiation of annual commercial agreements, selective distribution and other distribution schemes, “unfair competition”, “restrictive practices”, law of contracts (e.g., “théorie générale des obligations”), etc.) as well as relevant experience in drafting sales and distribution agreements and advising on French and EU commercial and distribution law issues. The candidate will also ideally justify of a significant experience in one or more of the following areas: •Consumer law; •Distant selling and online transactions; •IT contracts; •Data protection.

Ability to communicate and interact with others Assistance and guidance will always be available, but the successful candidate should be able to work autonomously and use initiative. Independent judgment will be required when making decisions/solving issues.
Additional Requirements
Internal: close relationship with the members of the EMEIA legal department. The relationship with the legal head for South EMEIA will be one of support with any assistance or guidance the candidate may require for the role. There will also be close relationships with the relevant business teams, including at senior management level. External: Outside legal advisors and public authorities. Occasional travel required.
