SECTION 1 - POSITION SUMMARY

Position objective

To create and maintain a secure legal framework related to a wide range of activities of the European Stability Mechanism (“ESM”) and the European Financial Stability Facility (“EFSF”), in particular with regard to commercial contracts and procurement.

Key accountabilities

  • Draft, review and negotiate commercial contracts from a legal point of view with external service providers and suppliers (ensuring that business objectives are met without compromising the protection of the ESM and EFSF);
  • Review procurement documents from a legal point of view and provide support in the drafting of procurement related legal documents;
  • Advise the various business areas on the interpretation of contracts and procurement documents, the application of contract and procurement terms and any other legal points in relation to commercial contracts and procurement;
  • Maintain and apply the legal policies and procedures of the ESM and EFSF in relation to commercial contracts and procurement;
  • Ensure timely and comprehensive reporting of all relevant legal issues in relation to commercial contracts and procurement;
  • Support the legal team in managing all legal aspects of the ESM and EFSF, including the management of the ESM/EFSF’s relationship with external law firms;
  • Conduct research, prepare memos, develop the institutional knowledge base and remain informed on legal and regulatory matters and important trends which have an impact on the operations of the ESM and EFSF;
  • Complete the administrative tasks related to the above responsibilities.

Main interactions with other functions/external entities

  • Frequent interaction with various ESM and EFSF departments and divisions, external service providers and suppliers.

KEY SKILL SET

  • Excellent drafting, reviewing and negotiation skills in relation to commercial contracts and procurement matters in the English language;
  • Ability to ensure that business objectives are met without compromising the protection of the ESM and EFSF.

SECTION 3 - FORMAL QUALIFICATION AND EXPERIENCE REQUIREMENTS

FORMAL QUALIFICATIONS

Essential

  • Qualified solicitor/lawyer;
  • Excellent English skills (spoken and written).

Desirable

  • Other European language skills (in particular German and French).

PROFESSIONAL EXPERIENCE

  • Minimum of two years relevant experience (post bar admittance);
  • Experience in civil law and common law would be an asset;
  • Experience in a major international law firm or company would be an asset.
