Pakistan Description of the assignment: Prison Reform Legislative Expert (Mid-Level National Expert) Number of positions: 1 (Islamabad) Project name: Prison management improved in line with international standards (Output 6.1) Period of assignment/services (if applicable): 6 months starting July 2012 Proposal should be submitted at the following email address: fo.pakistan@unodc.org No later than 14 May 2012.   1. BACKGROUND The UNODC Country Office for Pakistan (COPAK) is tasked with assisting Pakistan through its recently developed Country Programme (CP) with a focus on needs related to illicit trafficking and border management, criminal justice and drug demand reduction and HIV. Within the criminal justice component of the CP, UNODC Pakistan is charged with enhancing the prison-related legislative framework, in particular the Pakistan prison rules. In order to properly fulfill this role, COPAK requires the services of an national consultant with a legal background and experience in drafting prison-related legislation, regulations and SOPs.

  2. MAIN OBJECTIVES, RESPONSIBILITIES AND DESCRIPTION OF THE PROPOSED PROJECT. Assignment objective: The objective of the consultancy is to support the implementation of Outcome 6 “Prison management improved in line with international standards” of COPAK’s County Programme. Specifically, the National Expert will assist COPAK and the International Prison Reform Consultant in the revision of Pakistan’s prison-related legislation and regulations, in particular the new prison rules..

Responsibilities and description: Under the strategic guidance and supervision of the Country Representative and the Programme Coordinator /Criminal Justice Advisor the consultant will be responsible for editing the draft of Pakistan’s new Prisons Rules and SOPs prepared by UNODC in line with the national legislation and international standards.

The Expert will undertake the following substantive duties and responsibilities:

  1. Coordinate with the international prison reform consultant to work on the new draft prison rules and new SOPS in line with international best practise.
  2. Review and edit the new prison rules and new SOPS in line with national legislation and international standards.
  3. Consult with relevant officials of the Government of Pakistan at provincial as well as federal level.

  4. SCOPE OF WORK, FEATUES AND DELIVERABLES OF THE PROPOSED PROJECT Expected Deliverables

  5. Regular consultations with the provinces of Sindh, Punjab, Baluchistan, Islamabad , Khyber Pakhtunkhwa, Azad Jammu Kashmir and Gilgit Baltistan on the new draft prison rules volume II.
  6. Incorporate the changes made to the new draft prison rules volume II suggested by the provinces.
  7. Produce a comprehensive final version for each of the province on the new draft prison rules volume II.

Methodology Editing the drafts of the new prison rules volume II will require close coordination with the International Prison Reform consultant, document review, and interaction (as appropriate) with relevant points of contacts from concerned ministries, provincial departments and agencies. Relevant supporting documents will be made available to the expert as required. In addition, the National Expert will liaise closely with UNODC. The structure of the draft rules to be completed by the National Expert will be agreed with UNODC Pakistan prior to starting.

Planning and Implementation Arrangements The National Expert will be home-based, with occasional travel to COPAK Islamabad office and national missions to provinces. The expert is expected to work closely with the Country Representative and the Programme Coordinator of Sub- Programme 2. The Programme Coordinator of Sub- Programme 2 will support and guide the work of the National Expert.

The National Expert will have documents approved by the Representative prior to release.

  1. REQUIREMENTS FOR EXPERIENCE AND QUALIFICATIONS • A professional, holding a university degree (Master’s degree or equivalent) in Law, International Law , plus approximately 5 years of relevant experience, including drafting of legislation. Previous experience in drafting of prison legislation is an asset.

• Excellent verbal and written communication skills in English.

• Ability to work under pressure and to meet tight deadlines.

  6. FINANCIAL PROPOSAL

Lump sum contracts

The financial proposal shall specify a total lump sum amount as well as daily rate based on the proposed number of days. Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diems, and number of anticipated working days). Suggested breakdown of payments is given below (deliverable based):

• 25% upon completion system analysis, design and development plan. • 50% upon completion of the web application. • 25% upon hand over of the system as well as complete documentation.

Travel;

All domestic travel including air fare and DSA should be covered in financial proposal. EVALUATION Individual consultants will be evaluated based on the following methodologies: 1. Lowest price and technically compliant offer When using this method, the award of a contract should be made to the individual consultant whose offer has been evaluated and determined as both: a) Responsive/compliant/acceptable, and b) Offering the lowest price/cost “responsive/compliant/acceptable” can be defined as fully meeting the TOR provided.
