Senior Appeals Counsel, P5 United Nations - Arusha,Tanzania


The post is located in the Office of the Prosecutor (OTP) of the Mechanism for International Criminal Tribunals (MICT) in Arusha, Tanzania. The incumbent will report directly to the Senior Legal Officer or other senior staff as directed by the MICT Prosecutor.  
    
 Responsibilities  
    
 Under the immediate supervision of the Senior Legal Officer (or other senior staff as the Prosecutor may direct) and general supervision of the MICT Prosecutor, the incumbent shall: 
-Co-ordinate, supervise, and lead the handling of appeals on the Prosecutor’s behalf before the Appeals Chamber and the handling of requests for certification to launch interlocutory appeals, the response to such requests by the defense, and interlocutory appeals; 
-Co-ordinate and supervise the provision of legal advice to senior management and trial teams within the OTP; 
-Handle a wide range of complex, multi-disciplinary issues, relating to matters of substantive international and national criminal law, evidence, procedure, policy, and ethics; 
-Conduct or supervise the review and analysis of final judgments and interlocutory decisions of Trial Chambers and ensure that advice is provided to the Senior Legal Officer and the Prosecutor on the advisability and grounds of appeal; 
-Conduct or supervise legal research and writing, review or supervise the review of trial records, and do or review the conduct of database searches, in relation to the preparation of appeal briefs and the handling of pre-appeal motions; 
-Draft or supervise the drafting of notices of appeal or requests for certification to appeal, and appeal briefs and pre-appeal motions or motion responses or replies and ensure their timely filing; 
-Prepare for oral argument of appeals, attend in court before the Appeals Chamber as lead counsel, and make oral submissions at appeal hearings or related proceedings; 
-Prepare and conduct, or supervise the preparation and conduct, on the Prosecutor’s behalf, for hearings, before the Appeals Chamber, for the admission of new evidence in terms of Rule 115 of the Rules; 
-Ensure compliance with the UN rules and regulations, MICT Statute and Rules of Procedure and Evidence, and compliance with orders or directives of the Appeals Chamber; 
-Conduct or supervise legal research, database searches, and other work, to provide legal advice to members of OTP and the Prosecutor; 
-Supervise, and be directly involved in, the preparation and delivery of in-house legal education within OTP; 
-Complete all assigned management tasks, such as actions relating to the timely functioning of the electronic Performance Appraisal System (e-PAS), with respect to the operations of the ALAD; 
-Supervise and encourage the development of the skills and capacities of members of the OTP, and act as a mentor to junior counsel; and, 
-Discharge promptly and competently any other tasks assigned.

Job Requirements

Education  
    
 Advanced law degree (Master’s degree or equivalent) from a university of recognized standing. First-level university degree in combination with qualifying experience may be accepted in lieu of the advanced university degree. Postgraduate studies in criminal or international law would be an asset. Membership in good standing of any Bar or law society in any recognized jurisdiction.  
    
 Work Experience  
    
 A minimum of ten (10) years of progressively responsible experience in criminal law is required, including substantial experience at the appellate level preferably at the ICTR, ICTY, or other international court or tribunal. The candidate should have sound experience in the management of multidisciplinary legal teams and demonstrated success in identifying legal issues, proposing sound litigation strategies, and achieving team goals with maximum efficiency and effectiveness.  
    
 Languages  
    
 English and French are the working languages of the MICT. For the post advertised, fluency in English or French is required and a good working knowledge of the other language is highly desirable.  
    
 Assessment Method  
    
 Evaluation of qualified applicants may include a written assessment which may be followed by a competency-based interview.

 Candidates are hereby advised that the MICT may not consider the appointment of any candidate with a conflict of interest with regard to the appeals cases that will be handled by the incumbent of the advertised position.
The appointment is limited to the Mechanism. Appointment of the successful candidate will be limited to the availability of funding and may not extend beyond completion of the appeal or appeals that the candidate will be assigned to. As the international criminal tribunals are not integrated in the Secretariat, UN Staff Members serve on assignment or secondment from their parent department/office if selected. Appointments of staff members in the United Nations are subject to the authority of the Secretary-General. Staff Members are expected to move periodically to new functions in accordance with established rules and procedures, and may in this context be reassigned by the Secretary-General throughout the Organization based on the changing needs and mandates.
