Background

The Office for Democratic Institutions and Human Rights (ODIHR) is the principal institution of the OSCE responsible for the human dimension. ODIHR is active throughout the OSCE area in the fields of election observation, democratic development, human rights, tolerance and non-discrimination, and the rule of law. ODIHR’s assistance projects and other activities are implemented in participating States in accordance with ODIHR’s mandate.

ODIHR assists participating States with their commitments to combat hate crimes through its Tolerance and Non-Discrimination Department. In particular, ODIHR assists with the delivery of training for criminal justice system professionals to better improve responses to hate crimes. To complement its current training programme, Training Against Hate Crimes for Law Enforcement (TAHCLE), ODIHR seeks to use its forthcoming publication, Prosecuting Hate Crime, as the basis for a training programme for prosecutors and judges.

With this objective, ODIHR seeks a curriculum writer to draft a training programme on hate crimes for prosecutors and judges. An interactive curriculum on prosecuting hate crimes will assist ODIHR in providing tailor-made training seminars that have the aim of strengthening legal professionals’ skills and knowledge to effectively investigate and prosecute hate crimes in line with international standards and OSCE commitments.


Tasks and Responsibilities

The Expert/Consultant will be tasked with developing a single training curriculum designed for prosecutors and judges on hate crimes. The training programme is expected to last up to 1,5 days. The training curriculum will need to:

- be based on OSCE commitments and the OSCE’s comprehensive concept of security in relation to hate crime;

- be based on international human rights and non-discrimination standards and the interrelationship between those standards and hate crimes;

- present a basic understanding of the different legal approaches to prosecuting and sentencing hate crime so that it can easily be adapted to the legal framework within a participating State;

- be motivational so that the participants appreciate the importance of prosecuting hate crimes and their professional role in combating bias and prejudice in their own communities;

- be informative and practical, by highlighting the common types of evidence used in prosecuting hate crimes;

- be interactive in nature;

- target the respective audiences (prosecutors, judges and lawyers) effectively and convincingly.

The expert will submit the following deliverables:

o A fully developed curriculum for the course, including handouts, role-play games and other interactive scenarios, as well as agendas and specific suggestions for those delivering the training;

o The curriculum will be based on basic content on hate crimes, including the publication Prosecuting Hate Crimes, provided to the consultant by ODIHR.

The expert will be expected to attend a meeting in Warsaw to discuss the objectives of the training, as well as a meeting in Warsaw to present the materials and provide advice on their delivery. The expert will also be expected to be available to Warsaw for further consultations if necessary.


Necessary Qualifications

A minimum of five years of relevant experience in designing, developing and delivering/running training courses in the area of human rights and non-discrimination, with experience designing training programmes or continuing education materials for legal professionals highly desirable;
Demonstrated expertise in the area of human rights; specific knowledge of tolerance and non-discrimination issues, and hate crime in particular, is desirable;
Professional fluency in English;
Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities;
Ability to establish and maintain effective working relationships with people of different national and cultural backgrounds whilst remaining impartial and objective.

Remuneration Package

Remuneration will depend on the selected consultant’s qualifications and experience and be in accordance with OSCE established rates.
