Job Purpose
 
To provide advice on employment law issues to the BA Group, in both contentious and non-contentious areas

To supervise and manage junior members of the team, including administrative staff

Principal Accountabilities

  • Provides business-orientated legal advice and support to the company on contentious and non-contentious employment law matters, anticipating obstacles and formulating solutions that are legally sound, practical to implement and advantageous to the business
  • In conjunction with the other members of the Employment Law Team and Legal Team identifies and responds to client departments’ requirements for legal advice and education for the better management of legal and commercial risk and to further the company’s commercial objectives
  • Advises BA Group management up to Director level on legal risk issues; identifying when it is necessary to bring in more senior lawyers or other specialist lawyers due to the potential legal impact of particular actions or decisions on the BA Group
  • Advises upon and manages a case load of Employment Tribunal and Employment Appeal Tribunal proceedings and appeals to higher courts
  • Provides support to complex disciplinary/grievance procedures
  • Advises in relation to individual employment matters/transactional matters/restructuring/TUPE/collective and industrial issues
  • Manages the provision of local and international external legal advice on employment law issues (including litigation); manages realistic budgets and targets to ensure that advice to BA is provided at appropriate levels of quality and cost
  • Provides advice on employment policy matters/pension issues and data protection issues with appropriate support

  • Credibility – Able to advise and counsel BA management up to director level and quickly gain their respect, and to maintain effective relationships with clients, colleagues and external lawyers
  • Ability to manage multiple competing priorities, resolution to stay focused on priorities under pressure and to follow through decisions
  • Initiative, flexibility and judgment in identifying most appropriate ways of working for self and clients
  • Mature and balanced understanding of the law and the business context in which it needs to be applied
  • Willing and able to challenge the client where necessary to serve the best interests of the company without jeopardising client relationship
  • Excellent technical legal skills
  • Proven ability to assess legal risk and provide sound advice to business clients as to the most effective courses of action based on business objectives, legal principles, risk and practical considerations
  • Excellent communications skills, both written and verbal
  • Highly developed influencing and conflict resolution skills
Essential Qualifications
  • UK Qualified Solicitor/Barrister who is likely to have a minimum of 2 years post qualification experience in employment law
  • Ability to instruct external Counsel directly
Experience
  • Recent experience as a legal advisor in employment law (some in house experience preferred though not essential)
  • Good knowledge of and familiarity with BA employment policies and their application and BA collective agreements (internal candidates only)
Expertise
 
Employment law expert knowledgeable in contentious and non-contentious work, specifically including experience of:
  • Restructuring ( incl. TUPE)
  • Employment litigation
  • Discrimination law
Knowledge of industrial relations law is desirable though not essential
