Introduction
The United States of America acting through the Millennium Challenge Corporation (“MCC”) and the Government of the Republic of Indonesia (the “Government”) have entered into a US$600,000,000 Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Indonesia through three projects: the Green Prosperity (“GP”) Project; the Community-Based Nutrition to Prevent Stunting Project; and the Procurement Modernization (“PM”) Project. The Government of Indonesia, acting through the Millennium Challenge Account Indonesia (“MCA-Indonesia”) intends to apply a portion of MCC funding to eligible payments under a contract for which this Request for Qualifications is issued. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use and distribution of MCC funding. No party other than the Government and MCA-Indonesia shall derive any rights from the Compact or have any claim to the proceeds of MCC funding.
This Request for qualifications follows the General Procurement Notice that appeared in dgMarket and UNDB online on May 13, 2013, on the MCA Entity website http://www.mca-indonesia.go.id/in/main_ind/pengadaan_detail/203/1 on May 9, 2013, and local newspaper Kompass on May 11, 2013.
Background of the Assignment
The MCC-funded PM Project will be implemented by the National Office of Public Procurement (“LKPP”) through two main activities: (1) Improving the procurement function by increasing the capacity and professionalization of the procurement function (the “Procurement Professionalization Activity”) and (2) Supporting the development of procurement policies and procedures for public private partnerships (“PPPs”) and for environmentally and socially Sustainable Procurement (“SP”) (the “Policy and Procedure Activity”).
The Procurement Professionalization Activity will be implemented through the newly established PSUs and will be conducted in two phases. The first phase requires LKPP to enlist up to 30 PSUs to participate in the MCC-funded activities and is expected to encompass years one to three of the compact term (“Phase One”). It is anticipated that an additional 70 PSUs will participate during the second phase which will run through to the end of the compact in April 2018 (“Phase Two”). Each participating PSU will agree to the terms and conditions of participation in the program as set forth in a Memorandum of Understanding (MOU) between the procuring entity and LKPP. In return for its cooperation, the procuring entity and its PSU will receive comprehensive capacity development through formal training and institutional and technical mentoring plus support for establishing an automated procurement management information system.
Objectives of the Assignment
MCA-Indonesia is seeking a senior level consultant to assist LKPP engage participating PSUs, monitor implementation of the MOUs and manage the team of consultants who will be soliciting the PSUs and providing legal, organizational, institutional and personnel mentoring.
Scope of Work
The Consultant shall perform the following tasks: • Assist LKPP to refine and implement a strategy to build understanding and support in the GoI for procurement reform and build interest among national and local government entities in participating in the Procurement Modernization Project. • Assist LKPP to refine and manage the process for selecting PSUs. • Assist LKPP to help candidate PSUs integrate budgeting, procurement planning and execution and contract management.
• Assist LKPP to identify and resolve barriers in concluding with candidate PSUs the Memoranda of Understanding (MOU) that sets out the conditions and commitments for participating in the Procurement Modernization Project. • Assist LKPP to identify and implement all necessary activities and processes for public relations and outreach programs that build support for procurement reform generally and interest in the activities of the Procurement Modernization Project in particular.
• Assist LKPP to fulfill its role and responsibilities as Implementing Entity as set out in the Implementing Entity Agreement with Millennium Challenge Account-Indonesia (“MCA-I”). • Assist LKPP to continually update the five year work plan and develop periodic procurement plans to implement Phase One and Phase Two of the Procurement Modernization Project.
• Assist LKPP to assess the risk of implementing Phase One of the procurement modernization program evaluating the impact of each risk, identifying the probability of occurrence of each risk, and providing suggested actions to mitigate the risks. • Assist LKPP to revise the design and cost of the project, if deemed necessary based on consultation with MCC. • Assist LKPP to coordinate and organize the work of the team of procurement advisors and mentors supporting the cooperation with PSUs, especially on the following task:
o define an organizational structure appropriate for each spending entity for executing procurements effectively and efficiently, o develop criteria for equipment and personnel needs to carry out the functions of each PSU, o identify training needs of each PSU to set up and sustain the procurement function to serve the procurement needs of its spending organization, (d) identify obstacles - legal, technical, and political, including budgeting and financial management issues - to organizing each candidate PSU and the actions or policies needed to overcome these obstacles and o Identify the special needs of each PSU and to develop a plan to adapt the elements of the Procurement Modernization Project to the special needs of each PSU. • Assist LKPP to gather information from PSUs needed to support development of the policies and procedures for framework contracts and to support implementation of framework contracting in PSUs. • Assist LKPP, as requested, to coordinate and manage the Project Implementation Team set up in LKPP to support the implementation of the PM Project. • Ensure maintenance of organized project files. • Other tasks may be assigned as it relates to the scope of this assignment.
Qualifications
Interested Individual Consultants will be evaluated based on the following qualifications:
The consultant must have the following mandatory qualifications: • Minimum 10 years of professional work experience in tasks that are relevant to the activities in this assignment and that demonstrate that the Consultant possesses the knowledge and skills to perform this assignment successfully • Experience working with or in central or local government is required and must be sufficient to demonstrate that the consultant has an understanding of the organizational structures and operation of government entities • Experience coordinating and organizing the work of a team of employees/consultants • Bachelor level degree or equivalent in Business Administration, Economics, Accounting and Finance, Public Administration or field relevant to tasks of this assignment is required.
• Excellent oral and written English language communication skills (including ability to write technical reports in English).
In addition to the above the following qualifications are desirable: • Advanced level degree in Business Administration, Economics, Accounting and Finance, Public Administration or field relevant to tasks of this assignment. • Understanding of governance and public procurement issues in Indonesia • Experience engaging with local government officials • Work experience in Indonesia • Knowledge of Bahasa
Duration and Place of Performance
The contract term will be for a 12 month base period plus four 12-month option periods. For the base period of 12 months, the consultant will be expected to provide a level of effort of 12 months service in Indonesia. It is anticipated that this level of service of 12 full months will continue for the first option period and may decrease for each of the 3 remaining option years. The actual level of service for the option periods will be subject to negotiation between the parties when the option is exercised.
Selection Process
An Individual Consultant will be selected following the Individual Consultant Procedures as defined in the MCC Program Procurement Guidelines (available at the following Website:http://www.mcc.gov/pages/business/guidelines)
Individual Consultants’ CVs and related documents will be evaluated to determine if they meet the qualifications requirements stipulated in Section 6 (above). The education, adequacy for the assignment and language requirements will be evaluated. A Consultant shall be rejected if he/she fails to satisfy any of the mandatory requirements.
After the Evaluation of Qualifications, the Consultant that satisfies the mandatory requirements and is deemed most qualified will be interviewed in person or by telephone in order to confirm qualifications. References will also be checked. If the verification process supports the initial findings, the Consultant will be requested to submit a financial proposal and may be invited to negotiate the contract. Should negotiations fail with the most qualified Consultant, the MCA-I may at is discretion proceed to verify the qualifications of the next highest ranked Consultant.
Final selection will be subject to reasonableness analysis of the proposed fee. If verification is not satisfactory and the proposed fee is not reasonable, negotiations may be terminated.
MCA-Indonesia is not bound to accept any of the CVs or other documents submitted, and may cancel the selection process at any time without providing any justification to the Consultants.
Bid Challenges
MCA-Indonesia shall entertain a bid challenge from any contractor, supplier, or consultant that claims to have suffered or that may suffer loss or injury due to a breach of a duty by MCA- Indonesia in the conduct of this procurement. MCA-Indonesia will be following the interim Bid Challenge System as defined in the MCC Program Procurement Guidelines (available at the following Website: http://www.mcc.gov/pages/business/guidelines).
Any bid challenge shall be submitted in writing (may be in electronic form) to MCA-Indonesia within five (5) working days of when the contractor, supplier or consultant submitting the bid challenge became aware, or should have become aware, of the circumstances giving rise to the bid challenge. Unless the bid challenge is resolved by mutual agreement, MCA-Indonesia shall, within fifteen (15) days after submission of the bid challenge, issue a written decision stating the reasons for the decision and, if the bid challenge is upheld in whole or in part, indicating the corrective measures that are to be taken.
