Organizational Setting

The Office of Legal Affairs (OLA), which reports directly to the Director General, was established to provide legal services of the highest possible standard to the Secretariat and the organs and bodies of the IAEA, as well as to Member States, regarding the implementation of the IAEA's activities. There are three Sections in OLA, each responsible for a different field: the General Legal Section, the Non-Proliferation and Policy-Making Section and the Nuclear and Treaty Law Section. The incumbent reports to the Head of the General Legal Section.

Main purpose

The primary function of the incumbent will be to draft, negotiate and provide advice on contracts and other commercial agreements for the procurement of goods and services by the IAEA. The Legal Officer prepares legal opinions, legal instruments and documents and provides legal advice on the application and interpretation of such documents, primarily in connection with commercial contracts, administrative directives and personnel issues, under the guidance of the Section Head.

Role

The incumbent is an active member of a team of eight lawyers and two support staff within the General Legal Section and provides high-quality professional inputs to contribute to the support provided by OLA to the Office of Procurement Services, the Division of Human Resources, the Office of Internal Oversight Services, technical divisions in the IAEA and, through the Legal Adviser, to the Director General.

Partnerships

The Legal Officer collaborates with other officers in OLA and provides advice and guidance to procurement and HR specialists, senior managers, other administrative staff throughout the IAEA and the IAEA's executive management.

Functions / Key Results Expected

  • Negotiate with potential suppliers, draft and provide advice on commercial contracts and agreements.
  • Advise on the legal aspects of the IAEA's activities or projects under its auspices.
  • Draft agreements and communication with regard to Privileges and Immunities, Host Arrangements, insurance and financial issues.
  • Provide advice on the IAEA's administrative directives containing policies, and supervise their publication and incorporation into existing policies as set out in the IAEA's Administrative Manual.
  • Carry out research, prepare working papers, notes and reports within the field of work of the General Legal Section.
  • Prepare legal advice on the development and application of the IAEA's Staff Regulations, Rules and personnel policies.

Knowledge, Skills and Abilities

  • Excellent knowledge and considerable experience of contract law and procurement from the UN Common System or other International Organizations, particularly with regard to drafting, negotiating and advising.
  • Very good knowledge of administrative hierarchies and ability to maintain a consistent standard of excellence in legal drafting.
  • Ability to supervise staff.
  • General knowledge of IAEA activities.
  • Good knowledge and experience of HR Rules, policies and practices in the UN Common System or other International Organizations is an advantage.
  • Good knowledge of Privileges and Immunities, financial, Intellectual Property and insurance issues is an advantage.

Education, Experience and Language Skills

  • Advanced university degree in law.
  • Minimum of seven years of experience in contract law, including experience at international level.
  • Proven ability to draft complex contracts, prepare other legal drafts and advise management.
  • Excellent command of written and spoken English is essential. Knowledge of other official IAEA languages (i.e. Arabic, Chinese, French, Russian or Spanish) an asset.

Remuneration

The IAEA offers an attractive remuneration package including a tax-free annual net base salary starting at US $67 483 (subject to mandatory deductions for pension contributions and health insurance), a variable post adjustment which currently amounts to US $36 778*, dependency benefits, rental subsidy, education grant, relocation and repatriation expenses; 6 weeks' annual vacation, home leave, pension plan and health insurance.
