Background
Myanmar is at an historic stage in its development. A new Constitution was adopted in May 2008 and elections were held in November 2010 with bi-elections in April 2012. Parliament and governments have been formed at the national and region/state levels. A number of reforms have already been undertaken focusing on good governance, human rights and reaching cease-fire agreements in a number of conflict areas. These reforms are seen as positive steps, which have led to increasing engagement with the international community and allowed Executive Board of UNDP to lift mandate restrictions and to propose a fully fledged UNDP country programme.
Against this rapidly changing background, UNDP Myanmar is undergoing strategic repositioning and ramping up its capacities in order to effectively support national priorities of democratic transformation and poverty reduction. After more than 20 years of working exclusively at the grassroots level through the Human Development Initiative, the draft country programme for Myanmar (2013-2015) envisages contributions towards strengthening democratic governance, provision of policy advice for poverty reduction, strengthening resilience against climate change and disaster risk reduction, and targeted support for strengthening institutions of local governance.
In this context, Pillar 3 of the country programme addresses support to democratic governance, with four outputs including in particular an output on Rule of Law and Access to Justice as follows: Strengthened institutional capacity of the justice sector to formulate, implement and coordinate a comprehensive (nationally-owned, multi-stakeholder, gender-responsive and rights- driven) policy and strategy for the justice sector.
Enhanced capacity of justice actors for the development of a justice system that upholds the rule of law, protects human rights, promotes gender equality and improves access to justice, including through laws and regulations that are in conformity with the Constitution and international human rights standards.
Increased service delivery at the local level focusing on the rights of women and the rights of the most marginalized, in target States/Regions and in selected townships.
Empowerment of women and marginalized groups in selected pilot States/Regions to claim and have their rights adjudicated and grievances remedied.
Ethnic groups in cease fire and border areas have increased knowledge of their rights and are better able to access and benefit from expanded justice remedies.
Under direct supervision of the Team Leader, Democratic Governance and under technical direction from the Chief Technical Advisor for Rule of Law and Access to Justice, the Programme Specialist is responsible for implementation and overall coordination of activities under Output 3 of Pillar 3 of the Country Programme, including strategic planning, formulation and technical oversight of the programme, in close collaboration and coordination with project staff responsible for monitoring day-to-day implementation of activities in line with approved work plans. Furthermore the incumbent will be responsible for identifying synergies with other programs for ensuring cross-unit cooperation and coordination with other programme areas in UNDP, as well as the integration of cross-cutting themes, namely Gender, peace building, HIV/AIDS, ICT, peace building and reconciliation.
The Programme Specialist will also promote coordination and close collaboration with other outputs of Pillar 3, other relevant parts of the Country Programme (in particular local governance assessments and other local governance aspects of Pillar 1), the UNDP’s Bureau for Crisis Prevention and Recovery (BCPR) and UNDP’s Democratic Governance team and the Asia-Pacific Regional Centre in Bangkok.
Duties and Responsibilities
Key Results Expected:
  • Under the direct supervision of the Team Leader, Democratic Governance, and acting in close coordination with and taking technical leadership from the Chief Technical Advisor for Rule of Law and Access to Justice, the Programme Specialist provides strategic coordination and implementation in the programme area of Rule of Law and Access to Justice (ROL/A2J)
  • Is responsible for all daily management of the ROL/A2J programme, including work planning, budget allocations and revisions, programme implementation, monitoring and narrative and financial reporting on ROL/A2J
  • Leads the ROL/A2J programme Team in programme formulation and networking to ensure a programme which is relevant, in line with UNDP practice areas, UNDP Myanmar programme strategy and responsive to changes in the country context;
  • Implements the overall strategic vision of ROL/A2Jwith a view to building national capacities, establishing the rule of law and enhancing security, to support the overarching objectives of the Country Programme, in close collaboration with Programme, Programme Management Support Team and Operations;
  • Contribute for the achievement of UNDP Country Programme Outcomes on democratic governance, in particular on Rule of Law and Access to Justice;
  • Ensures the integration of cross-cutting issues, such as gender, HIV/AIDS, peace building, human rights and ICT, into the design, monitoring and evaluation of the ROL/A2J programme; Assesses the impact and effectiveness of UNDP’s ROL/A2Jprogramme in Myanmar;
  • Ensures regular monitoring and evaluation, including but not limited to regular visits and the participation of Programme Board and/or Steering Committee meetings.
  • Directly supervises programme staff on substantive programme issues related to the ROL/A2J programme.
  • Provides effective leadership to and management of ROL/A2J programme staff based in Myanmar
  • Has approval authority in Atlas and ensures the integrity of financial and administrative operations as well as the consistent application of UNDP rules and procedures for programme and operations issues related to the ROL/A2Jsector, in coordination with Operations and Programme Management staff and other support staff;
  • Participates in internal control mechanisms for adherence UNDP rules and regulations in contracts, assets, procurement, recruitment, etc. as required;
  • Ensures the achievement of the thematic goals in Rule of Law and Access to Justice for UNDP Myanmar.
  • Ensure high-quality and timely reporting to donors and other partners involved in the ROLS programme;
  • Contributes to the harnessing of effective partnerships and competitive selection of partners for implementation of UNDP projects.
  • Promotes joint programming and UN reform, and collaborates effectively in established frameworks for UN and other international coordination.
  • The Programme specialist ensures knowledge building and management focusing on achievement of the following results: 0 Promotes identification and synthesis of best practices and lessons learned from the programme area for organizational sharing and learning as well as external information;
    0 Actively participates in the knowledge networks and takes advantage of best practices and lessons learned that are available in the region and globally, and encourages staff in the programme area to do so by creating a culture of knowledge and learning;
    0 Uses and promotes the use of the Asia-Pacific Regional Center and BCPR services and integrates APRC and BCPR expert advice in the Programme design and implementation;
    0 Promotes the participation of UNDP Myanmar in regional programmes and regional activities related to the programme area as appropriate;
    0 Supports capacity- and knowledge building of national counterparts; 0 Any other tasks as assigned by the Team Leader, Democratic Governance and/or the Chief Technical Advisor for Rule of Law and Access to Justice
Impact of Results:
The key results have an impact on the overall success of the country programme and reaching CPD and project document goals. In particular, the key results have an impact on the design, operations and programming of activities, creation of strategic partnerships as well as reaching overall project targets.

Education:
Master’s degree in Law, political sciences, development, management or other relevant fields
Experience:
  • A minimum of 7 years progressively responsible and relevant professional working experience in the area of law and development; Proven experience of at least 5 years of specialist expertise in Rule of Law;
  • Proven management experience, preferably within UNDP or another UN agency, with sound knowledge and experience in all aspects of project cycle (design, implementation, monitoring & evaluation);
  • Prior experience of development work in Myanmar, South-East Asia and/or countries in transition would be an asset;
  • Strong interpersonal and written and oral communication skills; ability to work well in multi-disciplinary and multi-cultural teams
