HR Specialist (Legal) - WHO | Switzerland


OBJECTIVES OF THE PROGRAMME :
To provide integrated HR services, expertise and advice to facilitate the management of human resources, in accordance with the Staff Rules and Regulations, across the Organization. The specific objectives of the Department are to provide advisory services to Headquarters clusters and regional offices and to ensure the consistent and equitable application of the Organization's policies and activities for the development of human resources; to develop an integrated human resources policy covering recruitment, rotation and mobility, gender and geographical distribution, contractual arrangements, training and staff development, succession planning and performance management.
Description of duties:
  • Reporting to the HR Specialist (Legal), the work involves providing legal expertise to support the effective and fair management of human resources across the organization, including the development and application of human resource policies, processes, and statutory provisions. Specifically the incumbent:
  •  Researches precedents, conducts interviews, and analyzes cases of staff member(s), including on issues of performance, selection, contractual arrangements, entitlements, and other sensitive or complex human resource issues in order to provide advice, recommendations to management at HQ and in the Regions, or to staff;
  •  Drafts statements on behalf of the Administration for appeal cases heard by the Headquarters Board of Appeal or addressed directly to the Director General;
  • Provides input and/or reviews statements, particularly for cases of a complex or sensitive nature, prepared by the regional administrations for review by the Regional Boards of Appeal.
  •  Represents WHO/HRD at conferences and meetings related to personnel and due process issues; attends sittings of the ILO Administrative Tribunal;
  •  Provides advice to HQ and the Regions, based on interpretations of the Organizations rules, related precedents and practices, on the handling of appeals, as well as issues related to standards of conduct and disciplinary measures;
  •  Reviews, analyses, researches precedents, conducts interviews and provides recommendations to management for the resolution of cases through informal dispute resolution mechanisms, including in collaboration with the Ombudsman, as well as with the Staff Counselor and Medical Services on those cases which also involve issues of a psycho-social or medical nature;
  •   Analyses, summarizes and prepares interpretations of ILO Administrative Tribunal jurisprudence and HBA recommendations impacting on the Organization's statutory provisions, management of staff, HR policy framework; contributes to the development of proposals/provides advice for revised and/or new processes, changes in the management of human resources;
  •  Contributes to the development and revision of Staff Rules, Manual provisions and other information or regulatory tools, in order to reflect changes in the Organization's statutory and policy framework; and proposes the introduction of new statutory provisions;
  •  Provides training (through briefings) to HR Officers, to Management Officers in HQ Clusters and in the Regions in the understanding and application of WHO Rules and processes; provides advice on issues of HR policy; develops options appropriate for WHO within Organization's regulatory framework;
  •  Represents the Organization in meetings with other international organizations;
  •  Contributes to the development of new systems with a view to expanding the accessibility to, and transparency of the Organization's regulatory framework;
  •  Works in other areas of Human Resources Management and performs other related duties as required.
Under the supervision of Director HMS, the Staff member provides medical legal advice on complex medical cases.Upon briefing of the WHO Headquarters Health Medical Services Staff Physician, the Staff member autonomously provides technical expertise, helping in drafting all necessary documentation for complex medical cases to be presented to the ACCC, Pension Board or Medical Board as appropriate. This involves detailed analysis of available medical and legal documentation submitted by HMS Physicians, and regular communication with them, either by email or during meetings. Regular legal support and advice is expected in the preparation of the cases, as well as detailed argumentation and precise answers to HMS physicians questions and requests.
